Public Hearing and Notices
HHSC intends to renew the consultant contract for Information Technology Negotiation Support Services to continue services to provide information, advice, and assistance in various proposals IT negotiations.
HHSC will hold a public hearing on Tuesday, October 18, 2011, at 9 a.m. to receive public comment on proposed CDS option payment rates for employment assistance and supported employment services in the DBMD waiver program, and supported employment in the CLASS waiver program. The hearing will be held in the Lone Star Conference Room.

HHSC intends to submit an amendment to the Texas State Plan for Medical Assistance, which would modify the reimbursement methodology in the plan for ambulance services to specify that supplemental payments up to cost for governmental ambulance providers will no longer be made under the state plan for services delivered after September 30, 2011.
HHSC intends to submit amendments to the Texas State Plan for Medical Assistance to delete the pages in the plan governing the methodology for computing inpatient, outpatient, and physician supplemental Medicaid payments.
HHSC intends to submit an amendment that would allow HHSC to adjust Disproportionate Share Hospital methodologies related to the inclusion of claims associated with the 95-day claims filing deadline.
HHSC intends to submit to CMS a request to amend the DBMD waiver program, which would make supported employment and employment assistance available through the CDS option.

HHSC published four corrections to previous notices that appeared in the September 2 issue of the Texas Register:

Adopted Rules

HHSC adopted new Chapter 3, Administrative Responsibilities of State Facilities, consisting of Subchapter A, §3.101, definitions; Subchapter B, §§3.201 – 3.205, Criminal History Checks and Registry Clearances; and Subchapter C, §§3.301 – 3.306, Abuse, Neglect, and Exploitation, which establishes a separate chapter for state supported living centers and the ICF/MR component of the Rio Grande State Center to distinguish responsibilities of those facilities from others formerly associated with the Texas Department of Mental Health and Mental Retardation.
HHSC adopted the repeal of Subchapter K, consisting of §§4.501 – 4.509, Criminal History and Registry Clearances, and new Subchapter K, §§4.501 – 4.503, 4.505, 4.507, 4.509, 4.511, and 4.513, Criminal History and Registry Checks for Mental Retardation Authorities and Community Centers, in Chapter 4, Rights and Protection of Individuals Receiving Mental Retardation Services, which, among other things, clarifies the role and responsibilities of a mental retardation authority or a community center with regard to Texas Health and Safety Code, Chapter 250.
HHSC adopted the repeal of Subchapter K, consisting of §§7.501 – 7.505 and 7.507 – 7.518, Abuse, Neglect, and Exploitation in Texas Department of Mental Health and Mental Retardation facilities, in Chapter 7, DADS Administrative Responsibilities, which, among other things, provides that the HHSC executive commissioner shall adopt rules for the operation and provision of services by the health and human services agencies, including DADS.
